Global Compliance with Privacy Laws

Privacy laws requires you to manage and process opt-out requests. It’s illegal for you to use email addresses of people who don’t want to receive your emails. You shall give recipients an opt-out method, in other words you must provide a process that allows a recipient to ask you not to send future messages.

GDPR says that a data controller must comply to an erasure request “without undue delay”. There isn’t a specific term, but notice that penalties are up to €20 million, or 4% of the worldwide annual revenue of the prior financial year.

CAN SPAM Act requires an  opt-out mechanism and you must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $41,484.
